PARTICIPANT WAIVER, ASSUMPTION OF RISK, RELEASE OF LIABILITY & FACILITY AGREEMENT

PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS.

In consideration for being permitted to enter, use, participate in activities at, or otherwise access Mile High Golf Lab LLC ("Mile High Golf Lab"), including its golf simulator, lounge, equipment, furnishings, and premises, I agree to the following terms.

1. ASSUMPTION OF RISK

I understand that participation in indoor golf and use of a golf simulator involves inherent and other risks, including but not limited to:

• Being struck by a golf club, golf ball, or other equipment;

• Slips, trips, and falls;

• Muscle strains, sprains, overexertion, or other physical injury;

• Contact with walls, screens, furniture, fixtures, or other persons;

• Equipment malfunction or misuse;

• Injuries caused by another participant or guest;

• Damage to personal property;

• Risks associated with food or beverages brought onto the premises; and

• Other risks that may be foreseeable or unforeseeable.

I voluntarily choose to participate and knowingly and voluntarily assume all risks associated with entering and using the facility, whether described above or otherwise.

2. RELEASE AND WAIVER OF LIABILITY — INCLUDING NEGLIGENCE

TO THE FULLEST EXTENT PERMITTED BY COLORADO LAW, I KNOWINGLY AND VOLUNTARILY RELEASE, WAIVE, AND DISCHARGE MILE HIGH GOLF LAB LLC, ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, LANDLORD, AFFILIATES, EQUIPMENT PROVIDERS, AND REPRESENTATIVES FROM CLAIMS ARISING FROM PERSONAL INJURY, DEATH, OR PROPERTY DAMAGE CAUSED BY THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY.

This release is intended to include claims arising from, among other things:

• The condition or maintenance of the premises;

• The golf simulator, hitting area, clubs, balls, furniture, televisions, computers, monitors, or other equipment;

• The acts or omissions of Mile High Golf Lab or its representatives;

• The acts of other guests or participants; and

• My participation in or observation of activities at the facility.

This agreement does not release claims that cannot lawfully be waived under Colorado law, including claims based on gross negligence, recklessness, or willful or wanton misconduct.

3. RESPONSIBILITY FOR GUESTS

I understand that a reservation may include multiple participants or guests.

Every participant is expected to comply with Mile High Golf Lab's rules.

The person making the reservation is responsible for communicating facility rules to all members of the reservation group and for damage caused by the reserving party or its guests.

No person may participate if doing so would create an unreasonable risk to themselves, another person, or the facility.

4. FACILITY & GOLF SAFETY RULES

I agree to follow all posted rules and instructions, including:

• Only one golfer may occupy the active hitting area while another person is swinging.

• All guests must remain a safe distance from the golfer.

• Never walk in front of or near a golfer during a swing.

• Clubs must be used only for their intended purpose.

• Colored golf balls are prohibited.

• Guests are encouraged to bring their own clean, undamaged white golf balls for simulator use.

• No damaged, cracked, excessively dirty, or heavily marked golf balls may be used.

• Metal spikes are prohibited. Plastic or spikeless golf shoes only.

• Golf clubs and shoes must be reasonably clean before entering the hitting area.

• Simulator, computer, projector, TrackMan, television, monitor, lighting, and other equipment may not be moved, modified, unplugged, struck, climbed on, or tampered with.

• Food and beverages must remain outside the active hitting area and away from electronic equipment.

• Children must be supervised by a responsible adult at all times.

• Horseplay, reckless swinging, throwing equipment, or other unsafe conduct is prohibited.

Mile High Golf Lab may terminate a session without refund when unsafe, destructive, unlawful, or materially disruptive behavior occurs.

5. GOLF CLUBS & PERSONAL EQUIPMENT

Guests may bring and use their own golf clubs subject to facility rules.

Mile High Golf Lab also provides right-handed and left-handed golf clubs for guest use.

Shared equipment is provided as a convenience. Guests should inspect equipment before use and immediately discontinue use of any item that appears damaged or unsafe.

Guests are encouraged to bring their own clean white golf balls.

Colored golf balls are not permitted.

I accept responsibility for determining whether the equipment I choose to use is appropriate for me.

6. PROPERTY DAMAGE

I accept financial responsibility for damage caused by me, my minor child, or members of my reservation resulting from misuse, intentional conduct, reckless behavior, violation of facility rules, or use of prohibited equipment.

This may include damage to:

• TrackMan equipment;

• Projector or computer equipment;

• Impact screen or simulator enclosure;

• Televisions and monitors;

• Furniture;

• Walls, flooring, lighting, doors, or fixtures;

• Golf clubs or other facility equipment; and

• Any other property belonging to Mile High Golf Lab or the property owner.

I agree that Mile High Golf Lab may seek reimbursement for documented repair or replacement costs where I or a member of my reservation is responsible for such damage.

7. PERSONAL PROPERTY

I understand that Mile High Golf Lab is not responsible for lost, stolen, misplaced, or damaged personal belongings, including golf clubs, electronics, wallets, keys, clothing, or other property, except to the extent liability cannot legally be excluded.

Guests are responsible for securing and removing their belongings at the end of their reservation.

8. FOOD, BEVERAGES, PROHIBITED SUBSTANCES & CONDUCT

Mile High Golf Lab does not provide food or beverages unless specifically stated for a particular event or promotion.

Guests may bring their own food and non-alcoholic beverages subject to facility rules.

The following are strictly prohibited anywhere on the premises:

• Alcoholic beverages;

• Smoking of any kind;

• Vaping or use of electronic cigarettes;

• Marijuana or cannabis products;

• Illegal drugs or controlled substances not lawfully possessed; and

• Being under the influence of alcohol, illegal drugs, or any substance that impairs a person's ability to safely use the facility.

I agree to:

• Clean up after myself and my guests;

• Dispose of trash appropriately;

• Avoid spills near the simulator or electronic equipment;

• Leave the facility in reasonably clean condition;

• Comply with all applicable laws and facility rules; and

• Ensure that members of my reservation group comply with these requirements.

Mile High Golf Lab reserves the right to immediately terminate a session without refund for violation of these rules or for conduct that creates a safety risk, causes a disturbance, or may result in damage to the facility.

9. PRIVATE / UNSTAFFED FACILITY ACKNOWLEDGMENT

I understand that Mile High Golf Lab may operate as a private, limited-staff, or unstaffed facility and that a staff member may not be physically present during my reservation.

I accept responsibility for following all entry instructions, safety rules, operating instructions, and emergency procedures provided before or during my session.

I understand that access to the facility is limited to authorized guests with a valid reservation.

I agree that I will not:

• Allow unauthorized individuals into the facility;

• Prop open exterior doors;

• Share access codes, PINs, credentials, or entry instructions with persons outside my reservation; or

• Permit another person to use my reservation or access credentials without authorization.

10. RESERVATION TIME & FACILITY ACCESS

I understand that my reservation provides access only during the time period I have booked.

I agree to:

• Enter the facility no earlier than permitted by my reservation;

• Vacate the facility promptly at the conclusion of my reservation;

• Allow sufficient time to gather belongings and clean the space before my reservation ends; and

• Respect reservations scheduled before or after mine.

Remaining in the facility beyond a reservation time without authorization may result in additional charges or suspension of future booking privileges.

11. EMERGENCY MEDICAL CARE

If I am unable to provide consent during an emergency, I authorize reasonable emergency medical assistance to be requested on my behalf.

I understand that Mile High Golf Lab does not provide medical services and may not have personnel physically present at the facility.

I understand that I am responsible for medical costs incurred as a result of my participation or presence at the facility.

In the event of a serious emergency, guests should call 911.

12. INDEMNIFICATION

To the fullest extent permitted by law, I agree to indemnify and hold harmless Mile High Golf Lab and the other released parties from third-party claims, damages, or expenses resulting from my own negligent, reckless, intentional, or unlawful conduct or my material violation of this agreement.

13. MINORS

Participants under 18 must have this agreement completed or accepted by a parent or legal guardian.

As the parent or legal guardian of a participating minor, I:

• Give permission for the minor to participate in activities at Mile High Golf Lab;

• Acknowledge the risks described in this agreement;

• Agree to supervise the minor as required;

• Accept responsibility for ensuring that the minor follows facility rules; and

• To the extent permitted by Colorado law, knowingly and voluntarily release and waive the minor's prospective claims arising from ordinary negligence.

This parental waiver is not intended to waive any claim that Colorado law does not permit a parent or guardian to waive, including claims arising from gross negligence, recklessness, or willful or wanton misconduct.

14. SECURITY CAMERA & MONITORING ACKNOWLEDGMENT

I understand that Mile High Golf Lab may use security cameras, access-control systems, and other monitoring systems for:

• Safety;

• Security;

• Access control;

• Loss prevention;

• Investigation of property damage;

• Enforcement of facility rules; and

• General facility operations.

I understand that these systems are not intended to guarantee my personal safety or provide continuous live supervision.

15. RIGHT TO REFUSE OR TERMINATE ACCESS

Mile High Golf Lab reserves the right to refuse entry, terminate a reservation, suspend access, or prohibit future bookings when a participant or guest:

• Violates facility rules;

• Engages in unsafe or destructive conduct;

• Allows unauthorized access;

• Damages facility property;

• Uses prohibited substances;

• Smokes or vapes on the premises;

• Brings alcohol onto the premises;

• Creates an unreasonable disturbance; or

• Otherwise materially violates this agreement.

A session terminated for violation of facility rules may be ended without refund.

16. SEVERABILITY

If any portion of this agreement is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

17. COLORADO LAW

This agreement shall be governed by and interpreted under the laws of the State of Colorado.

18. ACKNOWLEDGMENT & ELECTRONIC SIGNATURE

I HAVE READ THIS AGREEMENT CAREFULLY. I UNDERSTAND THAT PARTICIPATION IN GOLF AND USE OF THE FACILITY INVOLVE RISKS. I UNDERSTAND THAT I AM ASSUMING THOSE RISKS AND GIVING UP CERTAIN LEGAL RIGHTS, INCLUDING CERTAIN RIGHTS TO BRING CLAIMS FOR INJURIES CAUSED BY ORDINARY NEGLIGENCE.

I UNDERSTAND THAT THIS AGREEMENT CONTAINS A RELEASE OF LIABILITY.

I UNDERSTAND AND AGREE TO THE FACILITY RULES, INCLUDING THE PROHIBITION OF ALCOHOL, SMOKING, VAPING, ILLEGAL SUBSTANCES, AND COLORED GOLF BALLS.

I SIGN OR ELECTRONICALLY ACCEPT THIS AGREEMENT KNOWINGLY AND VOLUNTARILY.
